Where Trust Meets Transparency
A Covenant of Interaction.
The Licence. We grant you a limited, refined licence to engage with this digital space. This invitation remains active provided the integrity of our terms is upheld.
Intellectual Sovereignty. The Healing Earth house, its trademarks, and its curated content are our exclusive property. We invite you to admire and engage, but the reproduction, reverse-engineering, or unauthorized use of our intellectual property is strictly prohibited.
Integrity of Engagement. By entering this site, you affirm your legal capacity to do so and commit to providing only accurate information. You engage with this space at your own risk; while we strive for perfection, we provide this website without warranties, and you indemnify the brand against any liability related to your use.
Limitation of Liability. Our maximum liability for direct claims is limited to R100. We do not accept responsibility for indirect or consequential damages.
The Principles of Transaction.
The Agreement. These terms govern the exchange of goods between the Healing Earth house and you, the customer. An agreement is formally concluded only upon the dispatch of your selection.
The Order.
- Duties & Taxes: International customs duties and taxes are for the customer’s account.
- Sovereignty: Each order is a separate agreement. We reserve the right to cancel any order, in which case a full refund will be provided.
- Global Standing: All agreements are concluded where you are domiciled, governed by the laws of South Africa.
The Delivery of Goods. We endeavor to dispatch your selection with deliberate speed. Risk passes to you upon delivery, while ownership remains with the brand until payment is settled in full. Your rights regarding product warranties are aligned with those of our primary suppliers and applicable law.
Intellectual Property in Goods. Our products are physical manifestations of our intellectual property. Purchase of a product does not grant a licence to its proprietary rights; we protect our mastery with rigor.
Fees and Settlement. Payment is due upon the date of transaction. We do not accept the withholding of payment for any reason. In the event of a dispute, our liability for direct damages is limited to the total fees paid for the goods in question.
Dispute Resolution. We prioritize harmony. Should a disagreement arise, we commit to a sequence of resolution: initial negotiation, followed by mediation, and finally, arbitration.
Termination & Force Majeure. We reserve the right to terminate an agreement should the provision of goods become impractical or legally burdened. Neither party is responsible for delays caused by circumstances beyond their control; however, if such circumstances persist beyond 60 days, the agreement may be dissolved.
Jurisdiction. This agreement is governed by the laws of the Republic of South Africa. You consent to the jurisdiction of the Magistrate’s Court for any legal proceedings.
